Job Announcement: Staff Attorney/Clinical Supervisor – Clean Slate Practice

The Clean Slate Attorney Position

The position is for an attorney who will support the work in the areas of DCOPP and Homelessness.

We expect the work will be 35% in the area of DCOPP and 65% in the area of Homelessness.

Primary responsibilities in support of the homeless practice will include:

Intake and direct representation of people experiencing homelessness, who have issues with service providers including discrimination, denial of services, eviction from shelters and transitional houses, discourtesy. Advocacy will include assistance with filing complaints, direct advocacy with supervisors within the service organization, advocacy with municipal and county funders.

  • Outreach, intake, and representation of homeless people in traffic court who receive infraction citations for violation of laws that criminalize activities necessary for their survival, or are discriminatorily enforced against people experiencing homelessness.
  • Outreach, intake, and representation of homeless people living in their vehicles who have received administrative citations and parking tickets as a result of inhabiting their vehicles, and assistance for those who have their vehicles/homes towed.
  • Organizing and supervising the assistance to class members in the Caltrans lawsuit in filling out claims for the destruction of their property.
  • Connecting people experiencing homelessness with the resources provided by the complete range of EBCLC’s practice areas.
  • Connecting people experiencing homelessness to resources in the community provided by the government, nonprofits, and volunteer organizations.
  • Working with government and non-governmental organizations to make sure services and resources reach the people most in need.
  • Policy advocacy on the local and state level to oppose laws criminalizing homelessness, and to support the sanctioning of encampments, provision of safe parking facilities for vehicular dwellers, services and actually meet the needs of people outside.
  • Research litigation strategies for defending the right to shelter, and developing connections with firms conducting litigation on behalf of homeless human and constitutional rights, with a view towards potentially co-counseling on cases that would benefit our clients.
  • Work with development on funding opportunities for the homeless practice.
  • Supervising student interns in homeless practice.
  • Additional tasks as assigned by Supervisor

 

Primary responsibilities in support of DECOPP will include:

  • Supervising Clean Slate DECOP’s Weekly In-House Traffic Clinic – conducting intakes and interviews and providing legal advice and referrals, brief services, and occasionally full-scope representation on an as-needed basis for people facing issues related to court-ordered and municipal debt, license suspensions, traffic court cases, and other related issues.
  •  Supervising Clean Slate’s monthly In-Court Traffic Clinic – conducting intakes and interviews and providing legal advice, brief services, and occasionally full-scope representation to people charged with moving infractions and quality of life infractions in Alameda County Traffic Court.
  • Follow up with and represent clients from both In-House and In-Court Traffic Clinics in a wide variety of cases, including traffic and non-traffic infractions, criminal cases, parking tickets, towing hearings, DMV administrative per se hearings, debt release/reduction cases with the Franchise Tax Board.
  • Additional task as assigned by Supervisor.

 

Minimum Qualifications:

  • A deep understanding of systemic racism and the causes of homelessness and mass incarceration;
  • Extensive experience working and relationship building with African-American clients (the majority of clients in DECOP and Homelessness are African-American);
  • J.D. degree required, member of the California State Bar in good standing, or successful completion of the California Bar Exam and awaiting completion of a background check.
  • Ability to manage a demanding caseload; excellent time management, priority-setting, and organizational skills;
  • Excellent written and oral advocacy skills;
  • Demonstrated and verifiable ability to work effectively with a diverse range of groups, including people of color, homeless people, immigrants, non-English speakers, people with mental disabilities, people experiencing domestic violence, law students, service providers, government employees, community partners, elected officials, and law school faculty ;
  • Strong interpersonal skills, flexibility, and demonstrated ability to work well independently and as part of a team;
  • Experience providing legal services to low-income people;
  • Experience with, or strong interest in, law student supervision and teaching;
  • Experience and/or willingness to do outreach to people experiencing homelessness in encampments, on the street, in parks, and wherever they may be.

Workplace Expectations:

  • Due to COVID19, all EBCLC employees are working remotely. The Staff Attorney/Clinical Supervisor and all EBCLC employees will continue to work remotely as long as California’s Shelter in Place remains in effect. The expectation is that the Staff Attorney/Clinical Supervisor will work in our office in Berkeley, California when it is safe to do. EBCLC will provide the necessary equipment to fulfill the job responsibilities of working from home.

Salary & Benefits: 

Starting salary for this exempt position is $60,000 – $90,000 based on a number of years of prior legal experience, as, as dictated by the EBCLC salary scale.
